Conflict Waiver sample letter
In the event your representation of a client includes multiple taxpayers it is very important to assess whether or not your representation of one is directly adverse to the other. If it is, you must have a candid conversation with all involved to explain the conflict and possible consequences of the conflict of interest. If you and your client(s) believe that you can represent them to the fullest, put the issues in writing and have all parties sign their understanding and agreement to continue together with you as their representative.
Declaration Statements
The legal declaration statements depending on who is providing the information should be at the end of all letters written to anyone at the IRS or State taxing agency to affirm the believed accuracy of the information being provided. The idea is that you have exercised due diligence to be sure that the information provided is as accurate as possible. It is my understanding that these statements are enforceable under the law. That is why they carry weight with the IRS as to the accuracy of the statements made.
